By accessing, installing, downloading, or using KryonVPN services, you confirm that you have read, understood, and agreed to these terms. You also agree to comply with all applicable laws and regulations regarding your use of KryonVPN. These terms constitute a legally binding agreement between you and Fusion Edge LLP. If you do not agree, please do not use KryonVPN services.

1. License Grant

KryonVPN (operated by FUSION EDGE LLP, company number OC455584, registered at Stoney Works, 8 Stoney Lane, London, United Kingdom, SE19 3BD) grants you a personal, non-exclusive, non-transferable, and revocable license to use KryonVPN services strictly in accordance with this Usage Agreement.

KryonVPN retains all rights not expressly granted under this license to the fullest extent permitted by applicable law. Any attempt to sublicense, assign, or transfer this license or any associated rights is null and void.

You affirm that you will use KryonVPN services solely for privacy and security purposes and in full compliance with all applicable local, state, national, and international laws and regulations.

2. Limited Warranties and Accountability

KryonVPN is under no obligation to store or transmit the contents of registered Accounts. Additionally, you waive any claims against KryonVPN and agree not to seek indemnification in the event of an inadvertent disclosure of confidential information due to a security breach or vulnerability in the use of the Services.

To the maximum extent permitted by law, you acknowledge and agree that KryonVPN shall not be liable to you or any third party under any legal theory for any indirect, special, incidental, consequential, or punitive damages. This includes, but is not limited to, the costs of replacement services, loss of data, loss of use, loss of profits, business interruptions, or any other financial or operational losses.

KryonVPN is also not responsible for any increased damages, legal expenses, or attorney's fees, whether under these Terms or otherwise, arising from or related to your Account, the Services, or this Agreement. This applies regardless of whether such claims arise under contract, tort (including negligence), strict liability, statutory law, or equity, even if KryonVPN has been advised of the possibility of such damages.

You further acknowledge that KryonVPN shall not be liable for any claims, demands, or damages resulting from your inability to use the Services or your Account.

3. Data & Privacy

At KryonVPN, we prioritize your privacy and take all necessary measures to protect it. We collect only the essential data required to provide our Services. KryonVPN's primary goal is to safeguard your online privacy, not your device. Unless explicitly stated otherwise, KryonVPN Services are not designed to function as antivirus or antimalware solutions.

KryonVPN does not store any personally identifiable information (PII) or track user activity within its Services. Any personal data required for specific procedures, such as payment transactions, is processed and stored by independent third-party service providers. KryonVPN does not access, manage, or control this data.

4. Costs and transaction processing

4.1. Aggregate Cost

The initial prices displayed for our Services may be listed excluding applicable taxes. Given the global nature of KryonVPN, determining exact taxes in advance is challenging. Any additional taxes (such as sales tax, VAT, or other applicable levies) will be calculated once you specify your tax residency. Before finalizing your payment, we will provide a full breakdown, including any applicable taxes and fees.

4.2. Payment Obligations

You agree to pay for all Services you purchase, including any applicable taxes and fees. If payment is not received in full on time, KryonVPN reserves the right to suspend or terminate your access to the Services. This may result in the loss of your account and associated content.

4.3. Recurring Payments

If you subscribe to Services on a recurring basis (e.g., monthly, yearly, or other predefined periods), you acknowledge that: a) Your subscription will automatically renew unless canceled. b) You authorize recurring billing using your selected payment method. c) KryonVPN may receive updated card details from your card issuer to ensure uninterrupted payment processing.

4.4. Methods of Payment

When purchasing Services through our Website, you must provide a valid and up-to-date payment method, such as a credit/debit card or any other payment options available on our platform.

4.5. Price Adjustments

We reserve the right to adjust the pricing of our Services, including subscription renewal fees, in response to operational cost changes. Pricing factors may include, but are not limited to:

• Licensing fees,
• Infrastructure and maintenance costs,
• Business expenses (e.g., payment processing, marketing),
• Administrative overhead (e.g., office rent, employee salaries, government taxes).

Any price changes will not affect your current subscription period and will only apply upon renewal. You will receive advance notice of any changes before your next billing cycle. If you disagree with the new pricing, you must cancel your subscription before the next payment date. Continued use of the Services after a price change constitutes acceptance of the new rate.

5. Terms and Conditions of the Referral Program for KryonVPN within the European Union

This Terms and Conditions agreement ("Agreement") governs participation in the referral program ("Program") of the KryonVPN mobile application ("Service") provided by FUSION EDGE LLP, a company registered in the United Kingdom. By participating in the Program, users agree to be bound by these terms.

5.1. General Provisions

5.1.1. The Program is provided by FUSION EDGE LLP, registered in the United Kingdom under company number OC455584, with its registered address at Stoney Works, 8 Stoney Lane, London, United Kingdom, SE19 3BD.

5.1.2. This Agreement applies to users residing in the European Union and the United States and complies with the relevant laws and regulations of each region, including, but not limited to:

• For the European Union:

  • General Data Protection Regulation (GDPR) (EU) 2016/679.
  • Directive 2005/29/EC on Unfair Commercial Practices.

• For the United States: - The California Consumer Privacy Act (CCPA), where applicable. - Federal Trade Commission (FTC) guidelines on endorsements and advertising. - The CAN-SPAM Act for electronic communications. - Data protection regulations enacted by other U.S. states, including but not limited to the Colorado Privacy Act (CPA), Virginia Consumer Data Protection Act (VCDPA), and New York SHIELD Act.

  5.1.3. Participation in the Program is voluntary and free of charge. By participating, users agree to be bound by this Agreement.

  5.1.4. The Service reserves the right to modify these terms. Changes will be communicated via the application, email, and the official website https://kryon.pro (opens in new tab).

5.2. Eligibility and Participation

5.2.1. The Program is available to registered KryonVPN users who reside in either the European Union or the United States, and have confirmed their email address.

5.2.2. To participate, users may:

• Copy their unique referral code.

• Share the referral link using standard operating system functions.

  5.2.3. Users earn referral points for each successful referral, provided the referred user registers and subscribes to KryonVPN.

5.3. Referral Points and Redemption

5.3.1. Referral points are awarded as outlined in the Program's terms displayed within the app. The number of points awarded may vary and is determined by the Service.

5.3.3. Promo codes are valid for 30 days from activation unless otherwise stated in specific promo terms.

5.3.4. Referral points and promo codes may be voided if found to result from fraudulent or prohibited activity, including violations of applicable regional laws.

5.4. Restrictions and Responsibilities

5.4.1. Referral points are awarded only for participants who meet all Program requirements.

5.4.2. Users must comply with applicable regional laws, including but not limited to:

• For the European Union: GDPR and laws against unfair commercial practices.

• For the United States: FTC guidelines, CAN-SPAM Act, and other state-level privacy laws.

  5.4.3. The Service reserves the right to cancel points, promo codes, or suspend user accounts for violations of these Terms or applicable laws.

  5.4.4. The Service is not liable for disruptions caused by external factors such as technical failures, third-party interference, or force majeure events.

5.5. Data Protection and Privacy

5.5.1. The Company processes personal data in accordance with regional data protection laws:

• For the European Union: GDPR.

• For the United States: Applicable U.S. state and federal laws, including CCPA, CPA, VCDPA, and the SHIELD Act.

  5.5.2. By participating in the Program, users consent to the collection and processing of their data for referral tracking and Program management.

  5.5.3. Users may exercise their rights under applicable data protection laws, including accessing, rectifying, or deleting their data, by contacting support@kryon.pro.

  5.5.4. The Company implements appropriate security measures to protect user data.

5.6 Modifications to the Program and Agreement

5.6.1. The Company reserves the right to modify these terms. Material changes will be communicated via the application, email, and website.

5.6.2. Continued participation after changes constitutes acceptance of the updated terms.

5.6.3. Users who do not agree with the changes may terminate participation by notifying the Service.

5.7. Applicable Law and Dispute Resolution

5.7.1. This Agreement is governed by the laws of the region where the user resides, including applicable U.S. federal and state laws or the laws of the European Union.

5.7.2. Disputes will first be subject to amicable resolution. Users may submit complaints via support@kryon.pro.

5.7.3. If disputes cannot be resolved amicably, they will be referred to competent courts in the user's country of residence or, if applicable, subject to binding arbitration in accordance with the region's laws.

6. Miscellaneous

These Terms do not limit any of your statutory rights or other legal entitlements that you may have as a consumer.

The headings within these Terms are for reference only and do not define, limit, interpret, or describe the scope or content of any section.

Our failure to enforce any provision of these Terms should not be interpreted as a waiver of that provision or any other provision.

We reserve the right to assign these Terms in whole or in part to third parties. We may also delegate our duties and responsibilities or hire contractors or agents to fulfill our obligations under these Terms.

These Terms constitute the entire agreement between you and us regarding your use of your Account or the Services, superseding all prior and current communications, proposals, or agreements, whether electronic, oral, or written, between you and KryonVPN regarding your Account or the Services.

In the event of any inconsistency between the English version of these Terms and any translated versions, the English version shall take precedence.
